About Brokerage Services

Before you enter into a real estate transaction, you have the right to know how your broker will work for you. The Texas Real Estate Commission requires that all real estate license holders provide you with this information about brokerage services.

A real estate broker may represent a buyer, seller, landlord, or tenant. The duties and responsibilities of your broker depend on who they represent in the transaction.

Types of Representation

• Seller's Agent: A seller's agent works solely on behalf of the seller and has duties to the seller including loyalty, confidentiality, disclosure, and reasonable care.
• Buyer's Agent: A buyer's agent works solely on behalf of the buyer and has duties to the buyer including loyalty, confidentiality, disclosure, and reasonable care.
• Intermediary: With the consent of both parties, a broker may act as an intermediary between the parties in a transaction. The broker must maintain impartiality and cannot disclose confidential information.
